This is a company registered in Romania with company number RO41451946 and Commercial Register number J23/331/2019. Our registered office is Stefanestii de Jos, street Hortensiei, nr 5, BL.N15b2, Ap.003, Ilfov, Romania.

The design, graphics, text, video, photos, symbols, scripts, source code, and other data used on this website are all the property of Lita Couture and are protected by copyright and other intellectual and industrial property laws. Without the express permission of Lita Couture SRL, any use of this information is forbidden and illegal. Lita Couture SRL is the registered owner of the LITA name and emblem.

TERMS AND CONDITIONS OF SALE

Acceptance of the Term and Conditions of Sale and conclusion of the contract.

The contract agreed between Lita Couture SRL and the Client shall be concluded with the acceptance, including partial acceptance, of the order by Lita Couture SRL. Lita Couture SRL saves the right not to process orders received from users who are not “consumers”, and any other order that does not conform with its business policy, such as orders for which there are reports or suspicion of illegal activity In such circumstances, the order shall be deemed void. In any situation, Lita Couture SRL shall promptly notify the Client if the order is not approved.

By using one of the methods offered and following the instructions on the website’s order form to place an order (referred to as a “Order” from here on), the Client attests to having read all the information supplied throughout the purchasing process and to having fully accepted these General Conditions.

USE OF WEBSITE

The Terms do not affect your legal rights. For more information about your rights contact a specialized advisor. Links to other websites or resources may be included in the Services provided by our website. We have no control over the information on these websites, and we will not be held responsible or liable for it in any manner. You are urged to review the terms that apply in regard to any such third party websites as we shall not be deemed to endorse or have any relationship with any other website, service, or products as a consequence of the Website linking to them.

Any content you submit to the Website or provide to us through any other channel (including social media) will be deemed non-confidential and non-proprietary, and we shall be free to use, reproduce, distribute, and make it available to third parties for any reason.

You agree to be accountable to us for and to hold us indemnified against all costs, damages, expenses, losses, and liabilities incurred and/or suffered by us as a result of any claim in relation to your use of the Services. We will not be responsible or liable to you or any third party for the content or accuracy of any materials posted by you or any other user of the Website and Services.

Some of the services or features on this website require registration before they may be used by you. You certify that all of the information you give when registering is true, accurate, current, and comprehensive. With or without prior warning and with no obligation to you, we may modify, discontinue, or temporarily or permanently suspend your ability to access the services.

We keep your account password confidential and safe, and you must notify www.litacouture.com right away if there is any security breach or unauthorized use of your account.

PURCHASING OF PRODUCTS

In order to make purchases on the website, you will be required to provide your personal details. Specifically, you must provide your real name, phone number, e-mail address and other requested information as indicated. Additionally, you will be compelled to provide payment details that you represent and guarantee are both valid and correct and you confirm that you are the person referred to in the billing information provided.

The website is available only to individuals and others who meet the www.litacouture.com terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to www.litacouture.com, whose applications are acceptable to www.litacouture.com and who have authorized www.litacouture.com to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase.

By making an offer to purchase merchandise, you expressly authorize us to perform credit checks and where www.litacouture.com feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Additionally, you consent to our use of the personal data you supply for the purpose of conducting necessary anti-fraud checks. You consent to the disclosure of your personal data to a credit reference or fraud prevention organization, which may record that data.

PRICES AND PAYMENT METHODS

Payment can be made by Visa, MasterCard, American Express, JCB, Discover, UnionPay. Payment will be debited and cleared from your account upon completion of the order process on the Website or other Service. You can also use PayPal, removing the need to enter your credit card details. When you select the PayPal option at checkout, you will be directed to the PayPal site to ‘Log In’ to your account and review the total amount to pay before clicking ‘Pay Now’. Once you click ‘Pay Now’ and you are returned to the Website, your transaction is complete. Regarding the terms and conditions established between you and PayPal or another payment intermediary, we shall have no obligation or duty.

You confirm that the credit/debit card or PayPal account that is being used is yours or that you have been specifically authorized by the owner of the same to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

To help ensure that your shopping experience is safe and secure, we (or our third party payment processors, as applicable) use industry standard security systems to encrypt your payment details to guard against unauthorized access.

You can save Credit Card details in your account and use them to complete future orders. For your security, you will always be asked to enter your CVV code at checkout. We receive authorization to charge your account once the order is placed and the pending transaction will be settled upon dispatch All credit or debit card orders are subject to authorization for security and fraud protection purposes, and our fraud team may require more information before processing an order.

Your order may be canceled by us at any time without prior notice. If your card information is recognized as fraudulent or is rejected by our fraud screening procedures, for instance, we may decide to cancel your order.

INSURANCE AND DELIVERY

Our delivery and returns representative LITA COUTURE SRL will deliver your purchases to you using DHL.

Ownership of any products ordered by you from us shall pass to you on the date and time of delivery to your nominated address.

We insure each purchase during the time it is in transit until it is delivered to your specified delivery address. A signature is required for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by us, and transfer of responsibility in the same way.

We shall be entitled to supply your purchases in instalments and each instalment shall be deemed to constitute a separate contract with us, and we shall be entitled to supply only part of an order.

SHIPPING

We will send you a confirmation email with your tracking number once your product has been shipped. Using this link, you may track and trace your order. Although functionality and uptime cannot be guaranteed, order status normally updates within an hour of the purchase being placed.

A signature will be required upon delivery of your order and we shall have no responsibility or liability for any failure to provide such a signature. Our service is not a named delivery service and anyone at the designated delivery address may sign for your delivery. We will not be liable for a lost or missing order that has been signed for at the address given by you by somebody other than you (for example, in an office address).

If no one is available to sign for the delivery, the driver will make a total of three delivery attempts on three consecutive business days. If there is still no one available to sign for the package, after 5 days with no communication, it will be returned to our warehouse.
When placing your order please ensure that the billing and shipping address details are correct as we are unable to redirect packages once an order has been processed. You are accountable for any false or omitted information you give us.

RETURNS & EXCHANGES

We hope that you are delighted with every order you receive from www.litacouture.com, however, if you are not satisfied with your item(s), you have 14 days upon delivery to return your order for a refund, exchange or credit note, valid for 12 months. Items received outside of this period will not be refunded and will be returned to the customer.

Please note that archive sale items are exchange only and that bespoke orders are final sale and are not eligible for exchange or return.

Items must be undamaged and in sellable condition and must be returned in their original condition in a sealed box, with all garment tags attached. Returns that have been worn, used, altered, or damaged will not be accepted and may be sent back to you and/or a refund refused. We cannot be held responsible for any missing returns or items during shipping transit.

Where provided, belts and any packaging such as instructions, authenticity cards, dust bags, and leather tags should be included with your return. Item(s) must be returned from the original shipping country with the original returns form.

Items bought through archive or sample sale are final sale and not eligible for refunds, exchange. We cannot accept returns or claims of LITA COUTURE pieces bought from other retailers or second hand sites.

Please note a restocking fee of €10 will be charged for returned item(s). This fee will be deducted at refund and does not apply for exchanges or credit notes.

RETURN POLICY

Please be cautious when trying on clothing because LITA COUTURE requires all things to be returned in brand-new, unworn condition with all tags and labels remaining attached. Damaged or stained returns will not be accepted, and they will be sent back to the purchaser with no promise of a refund or replacement.

To make your experience purchasing online even simpler, we provide a flexible returns policy. We keep track of how frequently customers return items, and if you continue to do so, your litacouture.com account may be closed or reported for potential refusal at our discretion.

Until they are given to our designated returns courier service, returned packages are the responsibility of the consumer. The item(s) must be returned through our free returns service; otherwise, the client is still responsible for them, and we cannot issue a refund until we have received the item(s). We advise keeping a copy of your proof of postage and sending your returns via a service that can be traced and signed for.

Due to high volume of orders and during sales period, your order might take up to 14 working days to be refunded. Once the refund is initiated, we will confirm via email and the funds should appear in your account within 3-5 business days.

Please note that items purchased through our stockists are subject to the returns policy of the individual stores.

REFUNDS

Refunds will be credited to your original method of payment. Original shipping charges will not be refunded. If your return was purchased in a currency other than your local currency, refunds will be paid in the same currency. Due to fluctuations in currency rates the amount refunded may be slightly higher or lower than the price originally paid. On receipt of return, we shall process the refund as soon as possible. We estimate that refunds will be made by the provider.

PRICES

Garment prices shown on the website are in EURO and are inclusive of VAT. Garment prices do not include delivery costs. The EURO price of a product displayed on the website at the time the order is accepted will be honored, except in cases of obvious error.

If you are a customer whose credit/debit card is not denominated in EUR the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Therefore, additional foreign bank fees can be applied by your card company or the supplier of your payment method. The value of these charges is beyond our control and beyond our ability to foresee. If this happens to you, please get in touch with your issuing bank before placing your order.

FAULTY OR DAMAGED GOODS

Goods are faulty if they are received defective. Items that sustain damage from regular wear and tear are not regarded as defective. Where possible, we will offer to repair faulty items. If repair is not possible or the same product is not available, you are entitled to a full refund. This does not affect your right to cancel the contract under the regulations.

LIMITS ON OUR LIABILITY

You have certain rights under the law in addition to those detailed under returns and cancellations. In Europe these include: that any products you order through the services will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on the website; and certain remedies if a product is defective. Nothing in these terms is intended to affect these rights.

We are not responsible for secondary losses (such as lost profits or missed opportunities) that result from the primary loss or damage but are not directly attributable to our breach or carelessness and are not reasonably foreseeable by you and us.

We are also not responsible for failure to meet any of our obligations under the terms where such failure is due to events beyond our reasonable control.

By placing an order you agree and understand that we may store and process your personal data in accordance with our privacy policy. OUR RELATIONSHIP

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and LITA COUTURE as a result of the terms or your use of the services. You agree that you may not and will not hold yourself out as a representative, agent, or employee of LITA COUTURE, and we shall not be liable for any representation, act, or omission on your part.

FINAL MENTIONS

Placing an Order on www.litacouture.com automatically implies the acceptance, without objections, the terms and conditions above, the equivalent of a valid contract. The Terms and Conditions on this site are subject to Romanian Law OUG 34/2014 and OUG 130/2000 regarding the Consumer Protection and does not affect any consumer rights provided by the law in force.
